How to file FAA Form 7460-1 (notice of proposed construction)
General information, not a substitute for the advice of an attorney.
Who grants it: Federal Aviation Administration, Obstruction Evaluation / Airport Airspace Analysis, filed online.
When it applies: Any structure more than 200 ft above ground, or lower structures near airports under the slopes in 14 CFR 77.9. Wind turbines and met towers always file; solar near an airport may also need a glare analysis.
What the application asks for, and where to find it
| The application asks for | Where you find it | How |
|---|---|---|
| Latitude, longitude and ground elevation of each structure | Your engineer | Per-structure coordinates from the layout; the report gives the site coordinates and USGS ground elevation for the spot. |
| Structure height above ground and overall height | Your engineer | Tip height for turbines, mast height for met towers, from the equipment data. |
| Structure type, marking and lighting proposed | Your engineer | From the turbine supplier and the lighting plan. |
| Nearest airport and distance | The agency's website | OE/AAA computes it from the coordinates once entered. |
| Sponsor (filer) details | You (the applicant) | Your entity and contact; one account can file many structures. |
What the "where you find it" column means
- This site: the land report
- Run the spot on the land report; the value is on the page named, with its agency source.
- Appraisal district (tax assessor)
- The county appraisal district record: property ID, legal description, acreage, owner of record, agricultural valuation. The report's Lease page links it; the Permits page lists the district's phone.
- The landowner
- Only the owner can supply it: signed authorization, deed reference, existing leases, access, their contact details.
- Your engineer
- From your civil or electrical engineer: site plan, disturbed acreage, drainage, the electrical one-line, nameplate and inverter data, structure heights.
- Surveyor or title company
- Boundary survey, legal description for recording, easements of record, title commitment.
- The agency's website
- The agency publishes it: forms, fee schedules, community numbers, district offices, portal accounts.
- You (the applicant)
- Your entity details: legal name, address, signatory, contacts, FEIN, insurance.
How to file it
- Create an account at FAA OE/AAA and start a Form 7460-1 for each structure (or a bulk upload for a wind farm).
- Check the notice criteria in 14 CFR 77.9 to confirm which structures must file.
- Submit; the FAA issues a determination (no hazard, with conditions such as lighting, or a hazard finding) that the lease and financing rely on.
- File the Form 7460-2 supplemental notice before and after construction as the determination requires.
